If a property is sold while I am still renting it, can the new owner evict me immediately?
No. Under Article 28 of Law No. 26 of 2007, the transfer of ownership does not affect the tenant's right to continue occupying the property under the existing lease contract, provided the contract has a fixed term. The new owner inherits the landlord's obligations and must follow the standard legal process to seek any change.
If you are considering buying a property that is currently rented, Prosper's buyer guidance also notes that the existing tenancy agreement and terms transfer to you as the new landlord — and if you wish to occupy it yourself, you must give the current tenant a minimum of 12 months' notice.
